CLINICDOTS HEALTHCARE TERMS AND CONDITIONS OF USE

1. Introduction
Welcome to CLINICDOTS HEALTHCARE. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and CLINICDOTS HEALTHCARE (“CLINICDOTS HEALTHCARE”, “we”, “us”, or “our”). These Terms govern your access to and use of our digital health platform, including all mobile applications, web portals, APIs, and backend systems (collectively, the “Platform”). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Teleconsultation: A remote consultation conducted digitally between a patient and a healthcare provider
3. Eligibility
You may use the Platform only if you are at least 18 years old or using the Platform under a legal guardian, you are legally authorised to use such services in your jurisdiction, and healthcare providers must be properly licensed. We reserve the right to restrict or terminate access if eligibility criteria are not met.
4. Nature of Services
The Platform provides appointment booking and management, Electronic Medical Records (EMR) access and sharing, teleconsultation tools, prescription and report management, and healthcare workflow support.

CLINICDOTS HEALTHCARE is not a healthcare provider. We do not provide diagnosis, treatment, or medical advice. We do not verify the accuracy or completeness of medical data entered on the Platform. All medical responsibility lies solely with the licensed healthcare professional. In case of emergency, contact local emergency services immediately.
4A. Patient Record Creation at Healthcare Facilities
When you visit a healthcare facility using CLINICDOTS HEALTHCARE, authorised staff may create or update your medical records. These records may be stored within the healthcare provider’s system and/or your personal device, are accessible only to authorised users based on consent and role, and are used strictly for clinical and operational purposes. CLINICDOTS HEALTHCARE facilitates data exchange but does not own or centrally control patient medical records.
4B. Technical Requirements
To use the Platform effectively, you must have a compatible smartphone or device, internet connectivity, supported OS (Android / iOS), and required permissions enabled. We are not responsible for issues caused by device limitations or network failures.
4C. Transfer of Agreement
We may transfer our rights under these Terms to another entity with notice. Users may not transfer their rights without written consent.
5. User Accounts
5.1 Registration
You must provide accurate and complete information when registering.
5.2 Account Responsibility
You are responsible for maintaining account security and all activities under your account. Notify us immediately of unauthorised access.
6. Consent and Authorisation
By using the Platform, you consent to data processing as per our Privacy Policy, electronic communication, and sharing data with selected healthcare providers. Healthcare providers confirm they have obtained patient consent before entering data.
7. General Usage Conditions
Users must use the Platform lawfully, provide accurate information, and avoid misuse or fraudulent activity. We may suspend accounts for violations.
8. Teleconsultation Services
Teleconsultation services are intended for non-emergency use, conducted by licensed professionals, and may not be suitable for all conditions. We are not responsible for clinical outcomes.
9. Service Availability
We aim for uninterrupted service but do not guarantee it. Downtime may occur due to maintenance or external factors.
10. Data Privacy and Security
We implement encryption, access control, and security monitoring. Refer to our Privacy Policy for full details.
10A. Data Storage Model and User Control
The Platform follows a decentralised, user-controlled data model where patient data is primarily stored on the User’s device and CLINICDOTS HEALTHCARE does not centrally store identifiable medical records by default. Data is shared only when Users choose to sync or share. If Users back up data (e.g., Google Drive), it is governed by the third-party provider. Healthcare providers may maintain independent records as Data Controllers.
10B. No Sale of Data
CLINICDOTS HEALTHCARE does not sell, rent, or commercially exploit User personal or medical data.
11. Payments and Subscriptions
Certain features may require payment. Fees will be clearly displayed. Non-payment may result in service suspension. Refunds follow the stated payment terms.
12. Third-Party Services
We may integrate third-party services such as payments, labs, and video tools. We are not responsible for their performance or policies.
13. Network and Device Limitations
We are not liable for service disruption caused by internet failure, device issues, or external systems.
14. Disclaimer of Warranties
The Platform is provided “as is” and “as available”. We do not guarantee error-free operation, medical accuracy, or continuous availability.
15. Limitation of Liability
To the extent permitted by law, CLINICDOTS HEALTHCARE is not liable for indirect or consequential damages, loss of data, income, or business, medical negligence by providers, or user errors or misuse. We are not responsible for data loss due to device failure, app deletion, lost credentials, or failure to back up data.
16. Termination
We may suspend or terminate accounts for breach of Terms, illegal activity, or regulatory requirements. Users may request account deletion via email.
17. Governing Law
These Terms are governed by the laws of India or applicable jurisdiction. Disputes will be handled in the relevant courts.
18. Changes to Terms
We may update these Terms periodically. Continued use indicates acceptance.
19. Institutional Responsibilities
Institutions using the Platform act as Data Controllers, must obtain patient consent, and are responsible for compliance. CLINICDOTS HEALTHCARE acts as a data processor.
